The work permit is a written certificate issued to foreign workers to allow foreigners to work legally in Vietnam. Applicants for work permits are required to fully meet the conditions specified in Article 9 of Decree No. 11 / 2016 nd-cp issued on February 3, 2016.

UAE citizens apply for work permits in Vietnam through the following two basic steps:

Step 1:

The employer (according to Article 2, paragraph 2, of the Decree No. 11 / 2016 / nd-cp) shall submit a written report on the needs of foreigners submitted at least 30 days before the expected date of employment of foreign workers(according to form 1 of Circular No.40/2016/TT-BLDTBXH) shall send it to Ministry of Labour, War invalids and Social Affairs or the provincial and municipal people’s committee where the enterprise is located.

Within 15 days of receiving the due diligence report, the competent authority will send a written approval/refusal to the employer.

Step 2:

• Submit a work permit. The application for a work permit includes the following basic documents:
• The Committee approved the notice of the position in which foreign workers were allowed to be employed.
• Application form for a work permit (Form No.07 issued in accordance with Circular No.40/2016TT-BLDTBXH).
• Health certificate or work health certificate issued by the competent authority. The health certificate is valid for 12 months from the date of issue.
• Judicial records or documents proving that foreign workers have not committed crimes committed by competent authorities. The criminal record is valid for six months from the date of issue.
• Documents proving that a foreign worker is a manager, executive director, expert, or skilled worker. The requirements may vary depending on the specific position of the employee. According to Article 3 of decree 11/2016/NĐ – CP of 3 February 2016.
• Notarized passport.
• 2 photos with 4×6 white background, taken within 6 months after the date of submission.
• Depending on each particular case, other relevant documents may be provided.

Note: For the documents and documents issued by foreign institutions/enterprises, except for the consular legalization exemption stipulated in international treaties, they must be legalized. Reciprocity according to law; translated into Vietnamese and certified according to Vietnamese law.

Within 10 days from the date of receiving the complete work permit application, the competent authority will return the result of granting / not granting the work permit to the enterprise.
